Article 1: General provisions:


The e-commerce website of Patio fashion , a BV with registered office at Bergstraat 38, 2220 Heist op den berg , VAT BE 0416737338, RPR Antwerpen, Mechelen (hereinafter 'Patio fashion BV') offers its customers the possibility to purchase the products from its webshop online.



These General Terms and Conditions ("Terms") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order through the 'Patio fashion' web shop, the Customer must explicitly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, except when they have been accepted in advance, in writing and expressly by 'Patio fashion'.


Article 2: Price:


All prices quoted are expressed in Euro, always including VAT and all other duties or taxes obligatory to be borne by the Customer.


If delivery, reservation or administrative costs are charged, this will be stated separately.
The indication of price only refers to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

 

Article 3: Offer:


Despite the fact that the online catalogue and the e-commerce website are composed with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind 'Patio fashion'. Patio fashion' is as to the accuracy and completeness of the information provided only held to a means commitment. Patio fashion is in no case liable for manifest mat erial errors, misprints or printing errors.

 

If the Customer has specific questions about e.g. sizes, colour, availability, delivery time or delivery method, we ask the Customer to contact our customer service department in advance.


The offer is valid while stocks last and can at any time be modified or withdrawn by 'Patio fashion'. Patio fashion' can not be held responsible for the unavailability of a product. If an offer has a limited validity or is made under conditions, this will be explicitly mentioned in the offer.


Article 4: Online purchases:


Order procedure

 

Phase 1: fill in personal information

 

Create an account: Fill in all your data and, if necessary, tick to subscribe to the newsletter and click on save.

 

 

Phase 2 Choose your fashion item

 

You can choose from clothing or accessories.

Click on the desired article on the right colour and size (fork) and check at the bottom of the page "add to basket" whether the article is in stock. Very important: with the size, there is usually a size range indicating the smallest and largest European German Dutch standard size.

Click on the dark beige bar “add to shopping cart”.”.

 

A pop-up appears with a photo description of the article, price including VAT, colour, size fork and quantity.
Total purchase amount appears on the right.  Possible shipping costs in case of shipment with "Mondial Relay" parcel service (of course free of charge in case of pick-up in a "Patio Fashion" shop).

Choose the delivery pick-up shop a) "Patio Fashion" Leuven b) "Patio Fashion" Heist op den Berg and click on continue.

If you want delivery via a pickup point "Mondial Relay":

Select your preferred pickup point and click on the dark beige bar "use this pickup point".

Then click on "continue"

 

Phase 4: Payment:

 

Overview with:

Your delivery address.

Your billing address.

Your shipping method.

Correct if necessary. More to the right you have the photo of the article, the description of the article, the size or measuring fork and the color and detailed and total cost of the order including VAT.
Then the customer must tick: I accept the general terms and conditions.

The Customer can choose between the following payment methods.

Credit Card Debet card Bancontact or Ideal.

             

Click on the correct payment method and follow the indicated payment procedure.
After payment, an order confirmation appears with a green bar and the e-mail with
details of the order is sent to the customer.

 

“Patio Fashion” is entitled to refuse an order due to a serious shortcoming of the Customer with regard to orders in which the Customer is involved.

 

 

Article 5: Delivery and execution of the agreement

 

The order will be transported to the designated Patio shop for collection within 4 working days or sent via “Mondial Relay” between 1 to 7 working days after the order.

Collection in the shop “Patio Fashion” Leuven or “Patio Fashion” Heist op den Berg is free.
Shipping only to collection point “Mondial Relay”

Items ordered through this web shop are delivered  in

Belgium € 4.50 VAT incl. And free from € 50 and will be shipped after 3-5 working days.

Germany maximum € 11 and free from € 75 and will be shipped after 4-7 working days.

France maximum € 6 and free from € 75 and will be shipped after 4-7 working days.

Grand Hertigdom Luxembourg maximum € 11 and free from € 75 and will be sent after 4-8 working days.
Italy maximum € 13.50 and free from € 130 and will be shipped after 4-8 working days.

The Netherlands maximum € 8 and free from € 75 and will be shipped after 4-8 working days.

Austria maximum € 13.50 and free from € 130 and will be sent after 4-8 working days.

Portugal maximum € 13.50 and free from € 130 and will be sent after 4-8 working days.

Spain maximum € 11.50 and free from € 110 and will be shipped after 4-8 working days.

Other countries on request.

 

Shipping via pick-up in shop "Patio Fashion" Leuven or "Patio Fashion" Heist op den berg is free.

 

Shipping only to collection point “Mondial Relay” to reduce our “ecological footprint”.


Unless otherwise agreed or expressly provided, the goods will be delivered to the "Mondial Relay" collection point chosen by the Customer within 30 days of receipt of the order.


Any visible damage and / or qualitative shortcoming of an article or other shortcoming in delivery must be reported immediately by the Customer to “Patio Fashion”.


The risk of loss or damage shall pass to the Customer as soon as he (or a third party appointed by him, who is not the carrier) acquires physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier was commissioned by the Customer to transport the goods and this choice was not offered by "Patio Fashion bv".

 

Article 6: Retention of title

The delivered articles remain the exclusive property of "Patio Fashion bv" until the moment of full payment by the Customer.


The Customer undertakes, if necessary, to draw the attention of third parties to the retention of title of "Patio Fashion bv", e.g. to anyone who might come to seize items that have not yet been paid for in full.

 

Article 7: Right of withdrawal

 

The provisions of this article apply only to Customers who, in their capacity as consumers, purchase articles online from "Patio fashion bv".

 

If the right of withdrawal applies:

 

The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving reasons".


The withdrawal period shall expire after 14 calendar days

a) from the day on which the Customer or a third party appointed by the Customer, who is not the carrier, takes physical possession of the goods.

b) or for web sales where the Customer has ordered several goods in the same order, which are delivered separately: " the day on which the Customer or a third party designated by the Customer and not being the carrier, takes physical possession of the last good.

c) for contracts relating to the delivery of a good consisting of several consignments or parts : " the day on which the Customer or a third party other than the carrier and designated by the Customer acquires physical possession of the last consignment or part.

 

d) for contracts relating to regular deliveries of goods during a specific period of time: " the day on which the Customer or a third party other than the carrier and designated by the Customer acquires physical possession of the first good".

 

To exercise the right of withdrawal, the customer must inform "Patio Fashion bv" Bondgenotenlaan 139 a in 3000 Leuven marketing@patiofashion.com of his decision to withdraw from the contract by means of an unequivocal statement (e.g. in writing by post or e-mail). The Customer may, but is not obliged to, use the attached model withdrawal form in duplicate.

 

The Customer may also complete the model withdrawal form or any other clearly worded statement electronically and send it via our website https://www.patiofashion.com. If the Customer makes use of this option, we will immediately send the Customer an acknowledgement of receipt of his withdrawal on a durable medium (e.g. by e-mail).


In order to comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

 

The Customer must return or hand over the goods without delay, but in any event no later than 14 calendar days after the day on which he has communicated his decision to withdraw from the contract to "Patio Fashion", in one of the two shops Patio Fashion bv Bergstraat 38 Heist op den Berg or Patio Fashion bv Bondgenotenlaan 139 in 3000 Leuven or by returning the goods, at the customer's expense, via Mondial Relay to pick-up point T'Winkeltje Tiensestraat 274 in 3000 Leuven. The Customer is on time if he/she returns the goods before the period of 14 calendar days has expired.

 

The direct cost of returning the goods is borne by the Customer, unless he returns the articles directly to the shop.

 

In order to comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

 

The Customer must return or hand over the goods without delay, but in any event no later than 14 calendar days after the day on which he has communicated his decision to withdraw from the contract to "Patio Fashion", in one of the two shops Patio Fashion bv Bergstraat 38 Heist op den Berg or Patio Fashion bv Bondgenotenlaan 139 in 3000 Leuven or by returning the goods, at the customer's expense, via Mondial Relay to pick-up point T'Winkeltje Tiensestraat 274 in 3000 Leuven. The Customer is on time if he/she returns the goods before the period of 14 calendar days has expired.

The Customer is requested to return the articles in their original state and packaging, with all accessories supplied and instructions for use. All returned articles are carefully examined. The basic principle here is that the Consumer may only inspect the item as he would be allowed to do in a shop. Returned items may be tried on, but must not have been used. When an article has undergone a reduction in value as a result of the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods. this will be charged to the Customer.

 

 

If the Customer withdraws from the contract, "Patio Fashion BV" will refund all payments received from the Customer up to that point, including the standard delivery costs, within a maximum of 14 calendar days after "Patio Fashion" has been informed of the Customer's decision to withdraw from the contract and has received the return shipment. In the case of sales contracts, "Patio Fashion BV" may wait to refund until it has received all the goods back, or until the Customer has demonstrated that it has returned the goods, whichever comes first.

 

Any additional costs as a result of the customer choosing another way of delivery than the cheapest standard delivery offered by "Patio Fashion" (handing over in one of the two shops: Patio Fashion bv Bergstraat 38 Heist op den Berg or Patio Fashion bv Bondgenotenlaan 139 in 3000 Leuven) will not be refunded.

 

"Patio Fashion BV" will refund the Customer with the same means of payment the Customer used to make the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such refund.



The Customer cannot exercise the right of withdrawal for:

 

service contracts (e.g. Retouches) after the complete performance of the service 

the supply or provision of goods or services of which the price is subject to fluctuations in the financial market over which "Patio Fashion BV" has no influence and which may occur within the revocation period;

● the supply of goods made to the customer's specifications or which are clearly intended for a specific person;

● the supply of goods which spoil quickly or have a limited shelf life;

the supply of sealed goods which are not suitable for return due to reasons of health protection or hygiene and the seals of which have been broken after delivery;

● the delivery of goods which, after delivery, are irrevocably mixed with other products due to their nature;

● contracts in which the customer has specifically requested "Patio Fashion BV" to visit him in order to carry out urgent repairs or maintenance;

● the provision of accommodation other than for residential purposes, carriage of goods, car rental services, catering and services relating to leisure activities, if the agreements provide for a specific date or period of performance;

 

Article 8: Warranty

 

Under the Act of 21 September 2004 on the protection of consumers in respect of the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

 

In order to make a claim under the guarantee, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

 

For items purchased online and delivered to the Customer's home or via a collection point, the Customer must contact the "Patio Fashion BV " customer service and return the item to "Patio Fashion BV" at his expense.

If a defect is found, the Customer must inform "Patio Fashion BV" as soon as possible. In any case, each defect has to be reported within a period of 2 months after it has been detected by the customer. After that, any right to repair or replacement expires.

 

The commercial and/or legal guarantee are never applicable to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or changes to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

 

Defects that become apparent after a period of 6 months following the date of purchase, or delivery if applicable, are deemed not to be hidden defects, unless the Customer can prove otherwise.

 

Article 9: Customer service

Any complaints can be addressed to this address. The Customer is requested to return the articles in their original state and packaging, with all accessories supplied and instructions for use. Cracked fabric?

The fibres of viscose/elastane/spandex become hard when ironed too hot. You do not notice this after ironing. But when you put the garment on later, the fibres 'break'. They lose their resilience and the quality of your outfit declines. This is a common user error, but not a clothing error

 

 

Article 10: Penalties for non-payment


Without prejudice to the exercise of other rights available to "Patio Fashion BV", in the event of non-payment or late payment, the Customer will automatically and without further notice be liable for interest of 10% per annum on the unpaid amount. Furthermore, the Customer shall be liable, ipso jure and without notice, to pay a fixed compensation of 10% of the amount in question, with a minimum of EUR 25 per invoice.

 

Without prejudice to the above, "Patio Fashion BV" reserves the right to take back articles that have not been paid for (in full).

 

Article 11: Privacy

 

The controller, "Patio Fashion", respects the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.

 

The personal data communicated by you will only be used for the following purposes: the execution of the concluded contract, the processing of the order, sending newsletters, advertising and/or marketing purposes. The legal grounds are: the execution of the agreement, the consent, the fulfilment of legal and regulatory obligations and/or the legitimate interest of the company.

 

You have a legal right to inspect and possibly correct, supplement or delete your personal data. You may also ask to limit the processing of your personal data in a number of cases listed in the AVG. You may also object to the processing of your personal data if you have serious and legitimate reasons for doing so that override our need to process your data. By means of a written, dated and signed request to "Patio Fashion BV " Bondgenotenlaan 139 a in 3000 Leuven marketing@patiofashion.com , you can retrieve your personal data in digital and readable form free of charge and/or have them transferred to other responsible parties. Article 14: Change of conditions


These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to, and the general sales conditions of "Patio fashion bv".  In case of contradiction, these conditions prevail.


Article 15: Evidence.


The Customer accepts that electronic communications and backups can serve as evidence.

 

Article 16: Applicable law – Disputes


Belgian law shall apply, with the exception of the provisions of international private law concerning applicable law.

 

The courts of the Consumer's place of residence have jurisdiction in the event of legal disputes. The Consumer may also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).

The ODR is an internet platform set up by the European Commission with the aim of solving disputes arising from e-commerce out of court.
